Now that it has scored a major
win for Linux in its legal
battle with The SCO Group
Inc., Novell Inc. has no
interest in becoming like the
company it's just defeated
and won't mount any
copyright-infringement claims
over Unix, a spokesman said
Tuesday.
"We're not interested in
suing people over Unix,"
Novell spokesman Bruce Lowry
said. "We're not even in the
Unix business anymore."
A judge
Friday upheld Novell's claims
to Unix copyrights that SCO
said it owned. Those
copyrights were the basis for
SCO's highly controversial
and ongoing Linux
patent-infringement suit
against IBM Corp.
Lowry said the ruling
means "the cloud has lifted
over Linux." Users and
distributors of the
open-source OS finally can
breathe a sigh of relief that
they are not in violation of
Unix copyrights. ..

Linux and Unix software from Microsoft? That will be one of the upshots of Microsoft's proposed buyout of Fast Search & Transfer, Microsoft officials
said today. But that doesn't mean you'll see Microsoft software shifting platforms.
"You shouldn't expect to see SharePoint
running on Unix," according to Kirk Koenigsbauer, general manager of Microsoft's SharePoint Business Group.
"Speaking of
Linux and Unix, some people may be (mis)interpreting our continued support and investment in these platforms as a broader change for Microsoft -- so
here's some color. We're making a pragmatic decision to continue to delight a core part of Fast's customer base that has chosen the Linux/Unix OS.
You can bet that we'll innovate on Windows, too, and over time we hope customers will see .NET as a preferred platform choice," Koenigsbauer wrote
in a blog entry on Microsoft's Web site today.

There are unlikely to be any new applications developed solely for Unix after 2009, George Weiss, a Gartner vice president and distinguished analyst,
told attendees at its annual Open Source Summit here Sept. 20.
"I expect that, around 2009, we will have seen the last
application developed specifically for Unix, after which no applications will be developed just for that operating system, though updates to existing
applications will continue for some time to come," he said in an address titled "Planning a Third Generation Linux Enterprise."
There will also be a gradual decline in the usage and market share of the Unix operating system, but that decline could well have a long tail, he
said, pointing to the fact that while IBM has its own Unix-based operating system, AIX, it is still active in the open source community.
"IBM is involved in Linux development and working on improving that operating system. Why would they be doing that if Unix was their bread
and butter?" he questioned.

Microsoft has big plans for the trusty old C: prompt. For its upcoming Windows Vista operating system, the company is developing a new command-line interface, or shell--the text-based controls typically accessed by clicking Command Prompt (under Start Menu, Programs, Accessories) in Windows XP.

A federal court in Utah ruled
that Novell Inc., not SCO
Group Inc., rightfully owns
the copyright on the Unix
operating system.
The ruling is likely
to significantly harm SCO's
separate 2003 lawsuit against
International Business
Machines Corp. and could
result in lifting a cloud of
suspicion that SCO had sought
to place over Linux, the free,
increasingly popular operating
system.
SCO had alleged that Linux
was an unauthorized knockoff
of Unix, which it claimed to
have purchased from Novell in
1995. IBM has been a strong
commercial proponent of
Linux.
But SCO never bought the
copyright to Unix, the court
ruled, in a 102-page opinion
by U.S. District Judge Dale A.
Kimball. The judge also said
that Novell had the authority
to force SCO to waive its
claims against IBM.
A spokesman for
Novell said its attorneys are
examining the opinion.

several court cases have found SCO Group GmbH, SCOs Germany branch, guilty of lying about Linux containing stolen Unix code.
In the first
case,
reported on by Heise Online, the pro-Linux
German companies,
Tarent GmbH and
Univention found that
SCO was once more making claims that Linux contained
Unix IP (intellectual property). Specifically, SCO GmbH made the familiar claims that "As we have progressed in our discovery related to this
action, SCO has found compelling evidence that the Linux operating system contains unauthorized SCO UNIX intellectual property (IP)." This was
followed by the usual threat "If a customer refuses to compensate SCO for its UNIX intellectual property found in Linux by purchasing a license,
then SCO may consider litigation."
