Is Microsoft 'capable' of stopping Vista Capable lawsuit?

Microsoft would dearly love the Vista Capable lawsuit to just go away, but once the wheels of justice start grinding, can any amount of grease stop the squeaky wheel?

Microsofts Vista Capable class action lawsuit is in the news again, this time because Microsoft wants an appeals court to reverse the decision to have granted the case official ˜class action status.

The whole situation bubbled up because a number of consumers felt duped by the Vista Capable sticker that implied a computer with such a label would be able to run Vista, presumably at least the ˜Home Premium version of Vista with the fancy Aero graphics, instead of the Vista Home Basic version which had no such capability.

Time labels iPhone as Invention of the Year

Stop. I mean, dont stop reading this, but stop thinking what youre about to think. Or, O.K., Ill think it for you:

The thing is hard to type on. Its too slow. Its too big. It doesnt have instant messaging. Its too expensive. (Or, no, wait, its too cheap!) It doesnt support my work e-mail. Its locked to AT&T. Steve Jobs secretly hates puppies. And—all together now—were sick of hearing about it! Yes, theres been a lot of hype written about the iPhone, and a lot of guff too. So much so that it seems weird to add more, after Danny Fanboy and Bobby McBlogger have had their day. But when that day is over, Apples iPhone is still the best thing invented this year. Why? Five reasons:

Japanese group wants Google to stop Street View

Google received another request on Friday to stop its Street View service, this time from a group of Japanese lawyers and professors who say the service violates their right to privacy. Talking to Reuters, Yasuhiko Tajima, a professor of constitutional law at Sophia University in Tokyo, said, "We strongly suspect that what Google has been doing deeply violates a basic right that humans have. It is necessary to warn society that an IT giant is openly violating privacy rights, which are important rights that the citizens have, through this service." Tajima heads the Campaign Against Surveillance Society, a Japanese civilian group that wants Google to stop providing its Japanese Street View service and to delete all saved images.

Drug cops stop to play Wii during raid

Being a drug cop must be a rather interesting job, particularly during raids; those under the target of the law tend to be rather wealthy, and certainly aren't afraid to show it. According to CNET, a group of drug cops showed their awareness of this by taking the time to play on a suspect's Nintendo Wii… during a raid. An alleged drug dealer named Michael Difalco was taken into custody by police, and his house raided for drugs as per usual. During said raid, the cops took some time out of their task to enjoy some virtual bowling, the whole time being caught on camera.

The Vistaâ„¢ Operating system can experience delays during shutdown if running a managed service that was designed with a ServiceBase.OnShutdown method that does not explicitly call the ServiceBase Stop() method on system shutdown. OEMs to Continue Shipping XP

If you already own an XP license and are still hesitant to switch to Vista, Microsoft's "downgrade rights" policy, which initially began to be exercised in 2001, may be in your favor if you would still like to purchase a machine running Windows XP after the June 30, 2008 deadline when Microsoft will stop offering the operating system. OEMs such as Dell have said that they still have no plans to stop offering XP as an option:

"Dell has the ability to exercise 'Windows Vista downgrade rights' on your behalf in the factory if your business is still reliant upon Windows XP and you'd prefer to have Windows XP Professional preinstalled on your PCs," according to their new downgrade policy section for XP.
"Downgrade Rights means that anyone with a Windows Vista Business or Windows Vista Ultimate operating system can downgrade to Windows XP Professional provided they have the media for Windows XP Professional."

Ten New Years Resolutions for the PC Industry

Happy New Years folks and that means it's time for New Years resolutions. We have some suggested resolutions for the PC Industry that will help them...and us!

#1 To the PC Makers: Stop pre-loading shareware. Nothing is more annoying than getting a new PC loaded with "trial versions" of programs. Just stop it.

#2 To Microsoft: Get Service Pack 1 for Windows Vista out there ASAP and make sure IE 7 doesn't hang anymore for no apparent reason.

#3 To Apple: Get that 3G iPhone out the door sooner rather than later. GPS on it would be nice too.

#4 To the RIAA: Just stop it. I mean, seriously, just stop.

#5 To Jack Thompson: Get a new hobby. Better yet, get a life. In a world in which one can't escape "The Girls Next Door" on TV are video games really a threat?

#6 To Google: Please make a Project Management extension to Google Calendar!

#7 To the BluRay and HD-DVD consortiums, please find a way to work together. You're just slowing down adoption (massively).

#8 To Amazon: Just because you think it might be patentable doesn't mean you should try to patent it.

#9 To Bloggers: This year is the US Presidential Election. Just remember, just because someone doesn't agree with your political opinion doesn't mean they're a bunch of sub-human monsters who eat babies.

#10 To Internet Users: Just remember that there is another person on the other side of that screen. Just because they aren't there to punch you in the nose doesn't mean you should surrender any semblance of civility on-line.

Have a Happy New Year!

RIAA to stop suing users, cuts them off instead

RIAA has reached an agreement to stop suing individuals who continue to share music illegally, but will cut your internet connection off instead. The decision was reached with ISP's to send a warning letter to individuals who have been suspected or caught by the RIAA, who will set up P2P listening posts to catch individuals and submit their information to their ISP. After 2 or 3 warnings, your ISP will slow your internet connection, and if a user continues to share music illegally, they will be shut off for good. RIAA has sued more than 35,000 people since they began operations in 2003, which was very costly to the music industry and time consuming.

Bang On: Time to move on from the compact disc

A few months ago, I moved out of my parents' house. As with any move, I took most of my personal belongings, but left a few behind to dig through later. Well, that "later" came today and I had to stop on by the house and go through the remaining knick-knacks to figure out what I should keep and what I should forever leave behind. When I put it that way, it sounds dire, doesn't it? Sorting through the small collection of random gadgetry wasn't that difficult. Old computer mice? Leave. Licensed copies of Windows XP and Vista? Let's take those with me. One random glove? No thanks.

Windows XP may get another reprieve

Ina Fried: With deference to my colleague (and boss), not ALL roads lead to Vista.

Although Microsoft is pushing hard to move everyone to the latest version of Windows, there are some market realities that are going to keep Windows XP around for some time--likely well beyond the current June deadline for large computer makers to stop selling the older operating system.

Microsoft has already extended the deadline once (XP was originally supposed to stop showing up on big-name PCs in January) and I would expect another extension to be announced soon.

Stop The Spread Of Vista SP1 Misinformation

Microsoft wants you to be informed about the current state of the Windows Vista SP1 beta,

"There will be a Windows Vista service pack and our current expectation is that a beta will be made available sometime this year. Service packs are part of the traditional software lifecycle - they're something we do for all Microsoft products as part of our commitment to continuous improvement, and providing early test builds is a standard practice that helps us incorporate customer feedback and improve the overall quality of the product."

"Service packs are just one example of the work we do to constantly improve the Windows experience. We also deliver improvements to Windows via Windows Update, which is an excellent channel for providing our customers with the most significant updates as they happen. And, since Windows Vista launched, we have continued working with partners to improve overall device coverage and application compatibility. There are now more than 2.1 million supported devices and more than 2,000 logoed applications for Windows Vista. We think customers will have a great experience using Windows Vista today."

"Spread the word to stop misinformation."

Microsoft set to release Vista Ultimate Extra games - free

Remember Vista Ultimate Extras? Well they are back according to Paul Thurrott, but this time they will be released for free in the form of two games, Microsoft Tinker and Hold 'Em. Microsoft's failed Vista Ultimate Extras were a big promise from the company of "cutting-edge programs, innovative services and unique publications." At least they were in Vista RTM, by the time Vista SP1 was rolled out nearly all references to Vista Ultimate Extras were removed (shown below). Blogger Long Zheng called them the "ultimate con" at the time and in hindsight he was right. Microsoft made several promises of more extras which resulted in the company launching UltimatePC.com which now redirects to the Vista home-page.

ZoneAlarm Security Suite 7.1 Adds Vista Support

Check Point Software today released ZoneAlarm Internet Security Suite 7.1, a Vista-compatible version of its flagship security suite. Vista-compatible versions of ZoneAlarm Antivirus and the popular free ZoneAlarm Firewall are also available.

Past versions of ZoneAlarm's products have relied on Microsoft's TDI (Transport Device Interface) to track network behavior. Windows Vista retains support for TDI, but introduces the new Windows Filtering Platform (WFP). While porting to Vista using TDI would have been easier, Check Point chose to support WFP for this Vista-compatible version. When installed on Windows 2000 and XP, however, version 7.1 will still use TDI.

Check Point is the first major security vendor to make use of the Vista-specific Windows Filtering Platform. Company representatives explained that Microsoft will stop fixing problems with TDI in the future, so by utilizing WFP, users can be prepared for Vista threats...

Vista Performance and Reliability Pack Unofficial Release

Thanks Nekrosoft for the news on this major update to Windows Vista that should for most of us improve the speed and reliability of Windows Vista significantly!

Please note: These fixes break all current methods of bypassing driver singing requirements except the good old F8 during boot (that you have to do every single time you start vista)

IF you are using Rivatuner, atitool and or Peerguardian on 64bit vista, you will have to use F8 every single time to disable driver signing requirements to use those two programs. x86 version is unaffected.

These updates should go official on the next patch Tuesday (in one weeks time). Please read more for the download links and information on these updates.
