Rapidshare To Be Forced to Shut Down Following Court Defeat?

The music industry in Germany has secured a legal victory over the hugely popular file-hosting service, Rapidshare. According to the rights holders, Rapidshare is going to have to stop its users from downloading infringing music tracks from its servers, or face the prospect of being shut down.



Last week we reported on rumors that Rapidshare had, or was about to be, shut down, rumors that now look likely to resurface. The company, one of the worlds largest one-click file hosting services, has lost a copyright infringement case against German performing rights outfit, GEMA. Representing a claimed 60,000 members and more than 1 million rights owners worldwide, GEMA has taken an aggressive stance in pursuing legal action against Rapidshare, trying to force it to be accountable for the infringing actions of its users.

Vista Transformation Pack 8.0 Released!

As ISPs choke file-sharing, users look elsewhere

As ISPs constrict file-sharing services such as BitTorrent, new data shows that users are moving to file-hosting Web sites to avoid slow downloads.



RapidShare and MegaUpload are among the most used file-hosting services. Together, the two sites account for 9 percent of all Internet traffic in the Middle East and 4 percent in Germany, according to iPoque, a company based in Leipzig, Germany, that specializes in traffic-management appliances for ISPs.



The percentages are significant since over the last year usage of file-sharing sites, which number in the dozens, has surged, said Klaus Mochalski, iPoque's CEO. The sites offer potentially faster download speeds for sharing files than peer-to-peer networks.

The Windows 7 Effect

First, there was the wait for Windows Vista. Then there was the wait for Windows Vista SP1. Now many pundits are claiming that enterprise users will hold off migrating to Windows Vista and wait for the release of Windows 7.



How can Microsoft counter this? By leaking information about Windows 7 of course!



Microsofts been having a tough time of late convincing people (important people, such as system admins and those with their hand on the check book) that Windows Vista is the future. Enterprises planning to deploy Windows Vista should not wait for Microsoft to release Vista's first service pack (SP1), due in early 2008, before doing so, according to a Gartner analysis.



In the analysis, titled Vista SP1 Is Important, but Less So Than SPs of the Past, Gartner research vice president Michael A. Silver noted that "Windows client service packs are important, but not as important as they used to be. Integrate Windows Vista SP1 if possible, but don't delay plans waiting for it."



Many organizations often wait until Microsoft releases the first service pack on its client operating system "before they test and plan deployment, he explained. But Microsoft "has become adept at deploying updates through services like Windows Update, Microsoft Update and Automatic Update, so SPs are now less important than they once were."



Another factor in play here: "Many organizations have highly complex PC environments and would not be ready to deploy Vista before , so SPI will not be in the critical path form them," Silver wrote...

Some customers are considering whether to deploy Windows Vista or whether to skip in anticipation of Windows 7.
The discussion is often phrased as one of balancing costs and timing of releases. By not deploying Windows Vista, it means missing out on the proven benefts such as better security, productivity, search, mobility, manageability, and infrastructure optimization. Windows Vista works with more applications and devices than ever before and can be signifcantly less expensive to support than Windows XP SP3.

There is no need to wait for Windows 7. It is a goal of the Windows 7 release to minimize application compatibility for customers who have deployed Windows Vista since there was considerable kernel and device level innovation in Windows Vista. The Windows 7 release is expected to have only minor changes in these areas. Customers who are still using Windows XP when Windows 7 releases will have a similar application compatibility experience moving to Windows 7 as exists moving to Windows Vista from Windows XP.

Historically, mainstream deployment occurs not when Microsoft releases a product but 18 months later. While the mainstream deployment cycle is beginning for Windows Vista now, it isn’t expected to begin for Windows 7 until at least mid-2011

Finally, after a year-long development phase, Microsoft Security Essentials have been publicly released. If you can't wait to get your hands on Microsoft's latest security software, you don't need to wait any longer. In June, a public-beta was offered, and the download limit was reached within 24 hours. It will be absolutely free for all users Windows XP, Vista and 7, both in 32bit and 64bit flavors — as long as you have genuine copy. Microsoft will not bundle it with Windows 7, though, when it's released on October 22nd, 2009.

Microsoft, not surprisingly, is advising customers against taking a pass on Vista. As part of a new white paper aimed at influencing business users who are evaluating when and whether to move to Windows Vista, Microsoft is advocating enterprise users should migrate to Vista sooner rather than later.



The white paper “The Business Value of Windows Vista: Five Reasons to Deploy Now” doesn’t include a lot of new data; instead, it revisits the business features Microsoft built into Vista and highlights some of the new deployment tools and case-study examples of companies who have migrated to Vista. Microsoft's Jeff Bell Calls Out Message Board Poster

This is a new one. Yesterday, NeoGAF message board poster "a Master Ninja" wondered aloud if a private message from user "bell801" could actually be from Jeff Bell, Microsoft's Corporate VP of Global Marketing for their interactive entertainment division, who endured Internet mockery for his wooden performance on-stage at the Microsoft press conference at E3 last week. The poster was especially critical of Bell during the press conference, which Bell didn't take kindly to, as his private message read:
    "And your contribution to society is...what?"
Wait, wait, wait. It's one thing to insinuate a high-ranking Microsoft executive has effectively called you out, but the connections grew as more people started watching the train wreck. Another user discovered Bell mentioned his GamerTag is "BigDaddy801" in a YouTube video, establishing the 801 connection between the two 'net names.

Are you missing some icons?

So you downloaded the new 8.0.0689 refresh, you sign in and all is well. You sign out and then sign in again some time... but wait, where did some of your icons go?

The WLM Beta team received several reports from users that some of their dashboard icons and features were missing when signing in the second time and every time after.

The problem was a result of errors within some of the programs entry points which caused them to vanish. However, the problem was fixed by the team and a fix has been sent out. For the fix to apply, you must sign out of WLM and sign back in. If your icons are not back, you have to wait about 30-60 more minutes and then try again as it takes time for the fix to reach every country.

Steve Ballmer believes it's ok to wait for Windows 7

Microsoft CEO Steve Ballmer has been at it again (no not the shouting) telling analysts that people can wait for Windows 7 if they like.

In a Q&A session with Gartner analysts Neil MacDonald and David Mitchell Smith at the Gartner Symposium ITxpo in Orlando, Ballmer said “Windows 7 will be Vista, but a lot better” according to ZDNet.

“If people want to wait they really can,” said Ballmer. “But I’d definitely deploy Vista” he noted. Unfortunately that's not likely to fill the confidence boots of investors or customers who have been put off by Microsoft's Vista offerings.

Earlier this month Ballmer hinted at a forthcoming operating system "Windows Cloud" that would help developers write Internet-based applications.

Microsoft will be revealing all about Windows 7 at PDC and will unveil exactly what Windows Strata really is too.
