Novel under the patent covenant is covered. "If you download from a third party, you probably have to speak to Microsoft," he added.

Novell will be delivering a Linux-based version of Microsoft's Silverlight cross-browser, rich Internet application technology within six months.
Miguel de Icaza, vice president of developer platforms at Novell, said at the XML conference here Dec. 5 that his team wanted to
ensure that Linux would not be a second-class citizen should Silverlight take off.

agreement with Microsoft as he defended himself against lack of patent protection for third parties that distribute his company's Moonlight project,
which ports Microsoft's Silverlight technology to Linux.
Speaking on a panel at the MIX 08 conference in Las Vegas, de Icaza
said that Novell has done the best it could to balance open-source interests with patent indemnification. However, if he had his way, the company
would have remained strictly open source and not gotten into bed with Microsoft. Novell entered into a controversial multimillion dollar cross-patent
licensing and interoperability deal with Microsoft in November 2006.

Novell Sides with Open Source in Microsoft Dispute
Novell is distancing
itself from Microsoft's
patent violation allegations.
The company reaffirmed its
stance: It doesn't believe
Linux violates intellectual
property. Novell directly
addressed the Fortune magazine
story in its corporate blog:
"We
disagree with the recent
statements made by Microsoft
on the topic of Linux and
patents. Importantly, our
agreement with Microsoft is in
no way an acknowledgment that
Linux infringes upon any
Microsoft intellectual
property. When we entered the
patent cooperation agreement
with Microsoft, Novell did not
agree or admit that Linux or
any other Novell offering
violates Microsoft patents."
Novell's
statement alludes to the deal
it made with Microsoft last
November. On the basis of that
deal, Novell would be immune
to any suits Microsoft might

It's that time again, another week and another Windows 7 build leak. They are really starting to flow now leading up to RTM and this time there
are changes to report. Last week we had 7229 leak and this week it's build 7232.winmain.090610-1900 that has wriggled out of Microsoft's
Redmond HQ and is being distributed across the net. The most obvious visual change is that a new default wallpaper has been set and there is no more
betta fish. The new wallpaper is named harmony. Windows 7 is still on track for a July RTM, and it's possible that it may even RTM by the end of
June.
