Microsoft indemnifies Novell Moonlight users

The Novell-sponsored project porting the Silverlight cross-browser plug to Linux is getting patent protection from Microsoft, indemnifying users from aggressive patent holders and litigators such as the Motion Picture Association of America (MPAA).

Microsoft will provide codecs worth $1m to every user downloading Moonlight from Novell under a special patent covenant, separate to the companies' broader - and controversial - patent protection and interoperability deal of November 2005.

Miguel de Icaza, Novell developer platform vice president leading Moonlight, told a panel on open source at Microsoft's Mix 08 conference anyone who downloads a codec from Novel under the patent covenant is covered. "If you download from a third party, you probably have to speak to Microsoft," he added.

MIX - Novell's de Icaza criticizes Microsoft patent deal

Open-source pioneer and Novell Vice President Miguel de Icaza Thursday for the first time publicly slammed his company's cross-patent licensing agreement with Microsoft as he defended himself against lack of patent protection for third parties that distribute his company's Moonlight project, which ports Microsoft's Silverlight technology to Linux.

Speaking on a panel at the MIX 08 conference in Las Vegas, de Icaza said that Novell has done the best it could to balance open-source interests with patent indemnification. However, if he had his way, the company would have remained strictly open source and not gotten into bed with Microsoft. Novell entered into a controversial multimillion dollar cross-patent licensing and interoperability deal with Microsoft in November 2006.

Novell Sides with Open Source in Microsoft Dispute

Novell is distancing itself from Microsoft's patent violation allegations. The company reaffirmed its stance: It doesn't believe Linux violates intellectual property. Novell directly addressed the Fortune magazine story in its corporate blog:

"We disagree with the recent statements made by Microsoft on the topic of Linux and patents. Importantly, our agreement with Microsoft is in no way an acknowledgment that Linux infringes upon any Microsoft intellectual property. When we entered the patent cooperation agreement with Microsoft, Novell did not agree or admit that Linux or any other Novell offering violates Microsoft patents."

Novell's statement alludes to the deal it made with Microsoft last November. On the basis of that deal, Novell would be immune to any suits Microsoft might file against open-source software vendors or the companies that use that software. ..

Novell says Microsoft deal is good for Linux business

Novell on Wednesday said its deal with Microsoft is helping drive gains in its Linux business, but danced around questions concerning how that deal may be altered given coming changes in open source licensing.

Novell made the comments during its quarterly earnings call with financial analysts where the company reported nearly a $2.2 million loss in income during its fiscal second quarter.

Novell executives danced around questions concerning its deal with Microsoft as it relates to the new GNU General Public License 3.0, which is expected to be approved as a final draft in June.

In addition, Novell CEO Ron Hovsepian would offer no comment beyond Novell's already published public statement on Microsoft's recent claims that Linux infringes on 235 of its patents. ..
