Windows Vista Capable Lawsuit Continues

The court case examines whether Microsoft's Windows Vista Capable and Express Upgrade programs were deceptive. Microsoft has lost the first round in a legal battle over whether its Windows Vista Capable and Express Upgrade programs were deceptive and led consumers to buy PCs that could only run the most basic version of the operating system.

The case was brought against the software giant, based in Redmond, Wash., by lead plaintiff Dianne Kelley of Camano Island, Wash. Kelley bought a new PC in November 2006 that had a sticker labeled "Windows Vista Capable" affixed to it. Windows Vista had not been released at that time, so customers bought machines with Windows XP preloaded and were given a coupon that allowed them to upgrade to Vista when the operating system was released at the end of January 2007.

Lawyers: Vista branding confused even Microsoft

Lawyers for plaintiffs in a case brought against Microsoft over Vista's marketing have claimed that even the software giant's marketing director was confused by the prelaunch campaign in the U.S.



The case involves the way Microsoft marketed PCs as "Windows Vista capable" prior to the consumer launch of the operating system in January.



Plaintiffs Dianne Kelley and Kenneth Hansen claim Microsoft was not telling the truth when it put the "Vista capable" logo on PCs that would be capable of running only Vista Home Basic. They contend that "Vista capable" implies that the machine is able to run all versions of Vista, rather than just the pared-down Home Basic version.

Division over next-generation DVDs deepening

Hollywood studios are becoming deeply divided over which high-definition technology will replace the DVD, increasing prospects that it will be years before next-generation players become standard equipment in U.S. households.



Paramount Pictures and DreamWorks Animation SKG Inc signed exclusivity deals to distribute their next-generation discs on Toshiba Corp's HD DVD format for the next 18 months, a move that evened a contest where Sony Corp's Blu-Ray Disc appeared to be pulling ahead.



Paramount expected the lower-priced HD DVD players, which start at $299 compared with $499 for Blu-Ray, to tempt consumers more this holiday season when summer box office blockbusters are released on high-definition DVD.



"We are in a very nascent stage in the world of high definition packaged media," said Kelley Avery, president of Paramount Home Entertainment. "Our approach is taking a look at what will motivate the consumer."

Microsoft Sued Over Windows Vista Marketing

A lawsuit alleges that Microsoft Corp. engaged in deceptive practices by letting PC makers promote computers as "Windows Vista Capable" even if they couldn't run the new operating system's "signature" features.



The proposed class action, which Microsoft disputes, was filed on behalf of personal-computer buyer Dianne Kelley of Camano Island. It focuses on efforts by Microsoft and computer makers to avoid a lull in PC sales by assuring consumers that the machines they were buying last year could run the delayed operating system upon its January release.



Machines carrying "Windows Vista Capable" stickers included those that only met the requirements for Windows Vista Home Basic -- which lacks the "Aero" on-screen appearance, Media Center PC interface, Flip 3D window-switching and other features available in advanced Windows Vista versions.



"All the 'wow' stuff that Microsoft is selling and marketing is present in (Windows Vista Home) Premium, but it's not present in Basic," said Michael Rosenberger, one of the lawyers representing Kelley in the case.

Microsoft Redefines "Vista Capable" as Minimum Experience

Two weeks ago, Dianne Kelley started a class-action lawsuit against Microsoft alleging the software company is engaging in deceptive practices by branding new computers with a Windows Vista Capable logo even if they could only run Vista Home Basic. Although Microsoft strongly refutes Kelley's claims, the threat of a lawsuit may have caused the software giant to change its description of the Windows Vista Capable program from:

Google to face AdWords jury trial

On November 9, Google will face trial over its AdWords programme, following allegations by American Blind & Wallpaper Factory that the system represents an abuse of US trademark law. Under the pay-per-click AdWords system, related adverts appear on a page of search results - it is very possible that by searching for a company, the company's competitor may appear as an advert next to the search results. In an April decision denying Google's motion to dismiss the case, the court ruled that the " evidence suggests that Google used mark with the intent to maximise its own profit ABWF has produced sufficient evidence of likelihood of confusion ".

Kelley Drye & Warren, the law firm representing ABWF, and its lead attorney David Rammelt, said: " The downside of search optimisation based on use of trademarks is rarely discussed. The reality is that companies large and small are hurt when Google uses a company's trademark, without permission, for the benefit of the company's competitors and Google. This is the first time that a jury will have the chance to hear how Google's business model takes advantage of companies that have built the value of their trademarks through hard work and investment ."

Changes to the layout

Since 2001, Neowin has always had separate categories for Main, Software and Gamers news, we further improved on this by adding tabs at the top of the page (with Shift v4, in October 2006), after feedback showed that many readers were unaware of the separate news pages.

With the new Finity design we have opted to display all of the news categories on the main entry page of Neowin, with the option to display all news of a certain category by selecting it from the main menu in the header, or by clicking on the category bar above the news title of an article page.

Windows Vista Capable Definition Hasn't Changed

Microsoft is denying a report in a Seattle newspaper that it has adopted new language to describe what's needed to successfully boot some of the more advanced parts of its new Windows Vista operating system as a result of a consumer lawsuit.



"Our language has been consistent all along; we haven't changed anything," a Microsoft spokesman said Tuesday.



An explanation of Microsoft's "Windows Vista Capable" program posted on the company's Web site states: "Some features available in the premium editions of Windows Vista -- like the new Windows Aero user experience -- may require advanced or additional hardware."
