France passes anti-piracy law

A bill requiring French ISPs to disconnect people who are caught downloading or sharing illegal content three times has been given approval by Senate. The controversial legislation will mean that illegal file-sharers will receive a warning through email first, then through a letter, and on the third offence, will face disconnection, according to an article by TorrentFreak. The bill attempts to reduce online piracy by deterring users from illegally file-sharing, and was supported by the French President, Nicolas Sarkozy. Users who are disconnected may have to continue paying for their internet for the duration that they are disconnected, which can be up to a year.

France close to 3 strike piracy law

Plans by the French government to require Internet service providers to throw persistent pirates off the Internet are now closer to becoming law.

The French Senate voted 297 to 15 in favour of the law, which now goes to the French National Assembly for final approval.

The law, first suggested by Nicolas Sarkozy in November 2007, requires that ISPs monitor web traffic of their customers. Those detected to be downloading copyrighted material illegally would be sent up to two warning letters, before having their internet connection cut off if they persisted to download illegally.

An amendment suggested by Bruno Retailleau of the right-wing MPF party, which proposed giving customers fines, rather than cutting them off, was rejected by French politicians prior to the Senate vote. Mr Retailleau said that the Internet has become an "essential commodity".

Retailleau is not alone. In April 2008, the European Union rejected calls for such a law to be imposed across Europe, saying that throwing people offline conflicted with "civil liberties and human rights".

France is not the only country taking measures to tackle piracy. Sweden has proposed a law that would allow copyright owners to request the personal details of anyone they suspect of copyright infringement from their ISP. Sweden is reportedly going to enact the law in April 2009.

The French National Assembly has shot down a bill that would have given music and movie industries an overwhelming amount of power to shut off end users internet access after a three strikes rule. "Under the plan, the music and movie industries would have been empowered to analyze the downloads of individual Internet users to root out instances of piracy, and to report violations to a newly created agency. The agency was to send warning letters to violators; after the third letter, the Internet service provider would have been required to sever service. " There was massive discontent in the entire country over the proposed legislation.

Vista Anti-Piracy Will Drive People to Linux?

Oh, the wicked 2007 predictions people make, just because it's the end of the year. The good folks over at IDC released their "Top 10 Predictions for Worldwide System Infrastructure Software, 2007." Overall, it's a good list, although I don't buy No. 9. IDC predicts: "Microsoft's client operating system anti-piracy efforts will backfire. Microsoft's anti-piracy campaign will drive customers toward Linux."

Bwhahahaha. Somebody has been tipping too much holiday eggnog. The anti-piracy campaign is biggest on the desktop--so, what? IDC suggests that Linux is finally going to gain desktop traction because of Windows product activation? Oh the tears, I'm laughing so hard.

More likely, new anti-piracy mechanisms will drive customers to Windows XP. More onerous piracy checks apply to Vista than its predecessor. Microsoft's nightmare situation is that customers stick with Windows XP and consume more Web-based products or services as means of extending operating system capabilities without upgrading.

Antipiracy investigators run afoul of Swiss law in P2P sweep

Part of the reason the RIAA is so relentless with its legal campaign against file-sharing in the US is that the group can readily obtain the names and addresses of broadband subscribers via John Doe lawsuits. In contrast, the motion picture and music industries have had mixed results with that strategy in Europe, and one firm retained by Big Content is under fire in Switzerland for what the Swiss government says are illegal tactics.



Logistep, which calls itself a "specialized privately controlled Anti-Piracy Company" that operates in Switzerland, has run afoul of the Eidgenössische Datenschutz und Öffentlichkeitsbeauftragte, the Swiss agency tasked with overseeing data protection, according to the IDG News Service. Unlike US law, which allows the identity of an ISP subscriber to be revealed via a civil action, Swiss law requires a criminal case to be filed in order for the data to be divulged.
