eBay beats Tiffany in court case over trademarks

EBay Inc. scored an important victory in court Monday, as a federal judge said companies such as jeweler Tiffany & Co. are responsible for policing their trademarks online, not auction platforms like eBay.

Tiffany had sued eBay in 2004, arguing that most items listed for sale as genuine Tiffany products on eBay's sites were fakes.

But U.S. District Judge Richard J. Sullivan in New York ruled that eBay can't be held liable for trademark infringement "based solely on their generalized knowledge that trademark infringement might be occurring on their Web sites."

The judge said that when Tiffany notified eBay of suspected counterfeit goods, eBay "immediately removed those listings." Although the online auction company refused to go further, by preemptively taking down suspicious listings for Tiffany jewelry, the judge said eBay didn't have to make such a move.

Tiffany: eBay is Rat's Nest for Counterfeiting

Tiffany & Co., the world's second-biggest luxury jeweler, called eBay is a "rat's nest" for counterfeiting and urged a judge to rule that the biggest online auctioneer was liable for infringement. In a legal brief submitted Dec. 7 to U.S. District Judge Richard Sullivan in Manhattan, the jeweler assailed eBay; both companies now await his ruling in a trademark infringement trial.

At issue is whether eBay must pay damages for failing to make adequate efforts to block sales of counterfeit silver jewelry. New York-based Tiffany and other retailers claim online sales of counterfeit clothes, bags and jewelry cost them about $30 billion a year. " At some point, eBay had to have realized that counterfeiting was rampant " on its site, lawyers for Tiffany wrote in their brief. " Indeed, it was a proverbial 'rat's nest.' "

EBay said in its brief that it's a "model citizen" in the fight against counterfeiting and that an adverse ruling might "wreak havoc" on some Internet-based businesses. The company has stated that the law places the primary burden to fight counterfeiting on retailers like Tiffany, which has devoted "relatively few resources" to the fight.

Phone cams forced to "audibly" click when taking pics soon?

According to the Library of Congress, eight-term US Republican Congressman Peter "Pete" King has introduced bill H.R.414 which would make it manditory that all camera phones make a "click" sound when they take a picture. The bill has been referred to the House Committee on Energy and Commerce and at some point may become the law of the land. The reasoning behind the submission is to stop people taking "secret" shots (in public toilets and changing rooms, for instance). The so-called "Camera Phone Predator alert Act" would also make it illegal and "impossible" for any such phone to be hacked to avoid making this sound.

Browse Your Digital Photos in 3D Stacks with PicMe

Freeware application PicMe scans your digital photo library and displays your pics in a flashy 3D-ish stacked interface. PicMe is primarily an image browser, and that's what it's best at, but you can also use it to share photos, either with photo sharing webapps like Flickr, Picasa Web Albums, or Facebook, or with PicMe contacts. The free version allows you to share 200 print-quality photos, so that's probably not your best choice for uploading your pics to the internet unless you really don't post that many photos. Either way, the interface itself brings a fresh way to browse your photos that may help liven up the way you interact with your photo library.

The Google Docs team, has posted on their blog about the availability of a few new features for Google Presentations to start off the new year. The most significant of the new features is the ability to embed slide shows in web pages. It's not a surprise that Google decided to go this route, given the huge success of embeddable video with YouTube and other embeddable content around the web.

New web threat takes advantage of iFrame vulnerability, making its way to the U.S.

Security firm Trend Micro said that it has discovered a new threat that is currently making the rounds on the Internet. The threat is based on an iFrame vulnerability in webpage code to plant a keylogger to steal user passwords, or turn computers into proxy servers for various other attacks.

Trend Micro said that the threat could have originated from a computer Trojan-making kit and relies on a scenario in which website owners are unaware that they are compromised, and website users are unaware that surfing through seemingly legitimate pages can actually be part of an infection process. This process, according to the security firm, involves a malicious IP address that is inserted into the HTML code (HTML_IFRAME.CU), a download of malicious Trojans (TROJ_SMALL.HCK, TROJ_AGENT.UHL, TROJ_PAKES.NC, PAKES) from another URL via a JavaScript routine.

TrendMicro said that the threat was initially detected in Italy, but apparently is making its way to the U.S.

Microsoft Announces Game for Nintendo DS

Although we probably wont ever be seeing Mario on the Xbox, one of Microsofts latest franchises will be hitting a Nintendo system.


Microsoft announced at Comic Con that Viva Piñata is headed to the Nintendo DS. The title will be based off the current title for Xbox 360 (also slated for the PC later this year) rather than the Party Animals mini-games package. The Microsoft-owned game developer studio Rare will be handling the development of this title in-house.


Rare describes the upcoming title in a news update on its website, This is a full-size Viva Piñata game in your pocket, featuring not only the entire range of paper beasts from the Xbox 360 title but also a few new ones thrown in to spice things up for those familiar with the established cast...

The Webware 100 winners were picked by users from a group of finalists that were selected by the editors of Webware.com, a CNET site. U.S. Consulate Web Site in Russia Breached

On September 10, the Web site for the U.S. Consulate General in St. Petersburg, Russia, was broken into and was serving up malicious iFrames, according to Sophos security researchers. After trying to load a malicious iFrame onto victims' systems from a remote server, the iFrame then attempted to silently load even more malware. The site, which has since been cleaned up, was actually only one of 400 compromised sites linking to two distinct malicious attack sites. The U.S. Consulate site was actually linked to both of those attack sites and was thus compromised with two malicious iFrames. One of the attack sites is hosted in the United States, while many of the compromised pages are in Russia.

Malicious script being loaded from the U.S. site tried to exploit several browser vulnerabilities in order to install a Trojan on victims' systems. Sophos says that the increasing use of automation to re-encrypt and obfuscate Trojans points to a need for a system to continuously monitor files in order to keep up with detection. " Automation is clearly being used-many script families are updated several times daily, and some of the notorious malware families are being rebuilt every 1-4 days ," SophosLab's Fraser Howard wrote in an August paper (PDF) titled "Modern Web attacks."

First Nvidia GeForce 9800GX2 Pics

The first pictures of what seems to be the GeForce 9800GX2 have just popped up on the web. We now have a good idea of what the card looks like. We know that the 9800GX2 has 2 printed circuit boards (PCBs), as did the 7950GX2 in its time, two graphics processing units (GPUs) using 65 nm nodes (most likely G92s with 128 stream processors), 1 GB of memory (512 MB for each GPU) and two DVI outputs. We don't know yet if the GeForce 9800GX2, which is supposed to be 30% faster than the 8800 Ultra, will support Quad SLI configurations. The expected price: around $449 US. Microsoft to Acquire Epic Games?

GamePro magazine is making a bold prediction: Microsoft will spend $1 billion this summer to acquire independent developer Epic Games.



In the latest issue of the magazine, according to a WRAL.com report, GamePro Assistant Editor Travis Moses wrote, "Microsoft will buy Epic Games for $1 billion." Epic, the company behind the award-winning Gears of War and Unreal Tournament III, is considered especially attractive because of their Unreal engine technology, which is used by numerous other developers for game development on the Xbox 360, PlayStation 3 and PC.
