Rapidshare To Be Forced to Shut Down Following Court Defeat?
section: common, for your questions: KezNews forum, 30.1.2008
Last week we reported on rumors that Rapidshare had, or was about to be, shut down, rumors that now look likely to resurface.
The company, one of the world’s largest ‘one-click’ file hosting services, has lost a copyright infringement case against German performing rights outfit, GEMA. Representing a claimed 60,000 members and more than 1 million rights owners worldwide, GEMA has taken an aggressive stance in pursuing legal action against Rapidshare, trying to force it to be accountable for the infringing actions of its users.
For its part, Rapidshare has always insisted that it cannot be held responsible for these actions, such as when users upload copyright works (in this case, music) to their servers for subsequent downloading by others.
On 23 January 2008, the district court in Düsseldorf (Landgericht) disagreed with this assertion after GEMA succeeded in convincing the court that Rapidshare should take responsibility for infringements carried out within its service.
GEMA are trying to imply that as a result of the decision, Rapidshare will be forced to take preventative action to stop GEMA works from even getting onto their servers, rather than a DMCA-style after-the-fact removal. GEMA says that if Rapidshare are forced to filter they will likely end up with a service that’s not worth operating, so they may decide to shut it down completely.

rapidshare sux arse!
how do
you figure this?
its a good backup service company. go, go rapidshare...!!
they can't take my rs away! too many people depend on it - i use it daily to share
files with my family and friends - without them, i'm screwed =(
this is not correct, the court case was against rapidshare.de and not rapidshare.com they
are two different companies within rapidshare.
a call to all the faithful. it's war on gema. it's your god given duty to shutdown
gema. attack gema sites, disparage gema products, you know what to do. it a call to arms
and a holy jihad against gema. and keznews, if you filter this call to arms a pox on you.
rapidshare is actually one of the better file hosts..no advertising, links not hidden
amongst the crap. sure there is a wait to download but you can overcome it easily if you
have a dynamic ip address. i donwload more stuff from rs than any other file host. mihd is
the best but not much is stored there.
anyway if rs closes then people will simply store files elsewhere. there are so many free
services to store files the fools at gema etc will have alot on their hands. i mean, dont
they remember what happened when napster closed down?
rapidshare fk
when rapidshare and every other disksharing site is gone, when demonoid and every other
torrent site is gone, when usenet and the newsgroups are logged and virtually shutdown,
when every form of p2p is gone, when your internet access is throttled and filtered, when
your last rights as a free human being are squelched, then who are you going to turn to?
microsoft, the mpaa, your governement - are you going to thank them for killing
off the next stage of digital evolution for the profit of a few and to the detrement of
the rest of humanity. for the benefit of a few, we kill the internet. yes, let
rapidshare die and a piece of you my friend will have died to.
let no man's
effort be for the benefit of all humanity. instead, lock it up under various hardend
security systems so that a few, a greedy few will benefit.
long live freedom.
